Obama US citizenshipQuestions about Obama’s US citizenship status referred to the Supreme Court
 Since early in the Primary season, there have been some questions raised about whether Barack Obama meets the constitutional requirements to serve as U.S. president. According to the US Constitution, to qualify to be the President, you must be a natural-born citizen. Rumors have circulated since the primary season that Obama was born in Kenya and not in Hawaii.
Philip J. Berg, Esquire, an attorney in Pennsylvania, filed suit against Barack H. Obama, challenging Senator Obama’s lack of “qualifications” to serve as President of the United States. His case was dismissed by a Federal judge in Pennsylvania due to lack of standing.
Mr. Berg then filed a Writ of Certiorari for review of the case and an injunction to stay the election pending review. Justice Souter denied that injunction, but has allowed the case to be reviewed by the US Supreme Court. Justice Souter has given both sides until December 5th 2008 to provided any documents to settle the matter one way or the other.
Mr. Berg remarked, “I look forward to receiving Defendant Obama's response to the Writ and am hopeful the U. S. Supreme Court will review Berg v. Obama. I believe Mr. Obama is not a constitutionally-qualified natural-born citizen and is ineligible to assume the office of President of the United States.”
The Obama Campaign has stated on their Fight the smears website that “The truth is, Barack Obama was born in the state of Hawaii in 1961, a native citizen of the United States of America.” Further the State of Hawaii has declared that Obama was born in Hawaii, but has not released a copy of his actual birth certificate, due to a long-standing policy of not releasing anyone’s birth certificate to the public.
It is expected that the Obama campaign will release a copy on Demeber 5th. If however, they are unable to do so, it may send the entire Presidential Election of 2008 into a constitutional crisis that will have to be decided by the Supreme Court
